Key & Hide is a brand operated by Pichel E-com, a business established in the Netherlands.
By using our website or placing an order with Key & Hide, you agree to these Terms of Service to the extent permitted by applicable law.
These Terms do not limit any mandatory rights you may have as a consumer under Dutch, European Union or other applicable consumer protection law.

3. CONSUMER RIGHTS
Nothing in these Terms excludes, restricts or limits rights that cannot legally be excluded under applicable consumer protection law.
If a provision of these Terms conflicts with a mandatory consumer protection rule applicable to you, the mandatory legal rule will prevail.
If you reside outside the Netherlands, the choice of Dutch law in these Terms does not deprive you of mandatory consumer protection rights applicable in your country of residence where those rights cannot legally be excluded.
4. OUR PRODUCTS
Key & Hide sells premium leather goods, accessories and related products.
We make reasonable efforts to ensure that:

product photographs provide a representative image;
-
materials are correctly described;
-
dimensions and specifications are accurate; and

available options are clearly displayed.
However, minor differences may occur between photographs displayed on a screen and the physical product.
Screen settings, lighting and photography may affect how colours appear.
Any material difference that affects the essential characteristics of a product will be communicated appropriately.
5. NATURAL LEATHER
Many Key & Hide products are made using genuine natural leather.
Leather is a natural material. This means that individual products may contain variations in:

grain;

texture;
-
shade;
-
colour;
-
markings;
-
creasing;
-
pores; and
-
other natural characteristics.
These characteristics can make each piece unique.
Reasonable natural variations inherent to genuine leather do not by themselves constitute a product defect.
However, this provision does not affect your statutory rights where a product is defective, materially differs from its description or otherwise does not conform to what you were reasonably entitled to expect.
6. PRODUCT CARE AND NORMAL WEAR
Leather products naturally develop signs of use and may develop a patina over time.
The appearance and lifespan of leather can be affected by factors including:

moisture;

water;
-
oils;
-
chemicals;
-
excessive heat;
-
prolonged sunlight;
-
abrasion;
-
improper storage; and
-
inappropriate cleaning products.
Customers should follow any care instructions supplied with a product or published by Key & Hide.
Normal wear and tear or damage caused by misuse, accidents, improper care or external influences is not considered a manufacturing defect.
This does not limit your statutory conformity rights.
7. PERSONALISED PRODUCTS
Certain Key & Hide products may be personalised, including through:

initials;

names;
-
text;
-
embossing;
-
debossing;
-
engraving; or
-
other individual customisation.
You are responsible for checking all personalisation information before submitting your order.
We will normally manufacture personalised products using the exact text or instructions submitted by you.
Key & Hide is not responsible for mistakes in personalisation information submitted by the customer, such as spelling errors, provided that we manufacture the product in accordance with the information supplied.
If the error is made by Key & Hide or the product otherwise fails to conform to the agreement, your statutory rights remain unaffected.
Certain personalised or custom-made products may be excluded from the statutory right of withdrawal where permitted by law.

8. UNACCEPTABLE PERSONALISATION REQUESTS
We reserve the right to refuse a personalisation request before accepting or producing the order if the requested content:

is unlawful;
-
infringes intellectual property rights;
-
infringes another person's rights;
-
contains discriminatory or seriously offensive content;
-
contains threats or unlawful harassment;
-
promotes illegal activities; or
-
cannot reasonably be manufactured using the selected product or personalisation method.
If an order has already been paid but we lawfully decline the personalisation request before production, we will refund the relevant amount unless an alternative is agreed with you.
9. PRICES
Prices displayed to consumers on our website are shown inclusive of applicable VAT where required by law.
Any additional costs, such as:

shipping;

delivery surcharges;

duties;
-
import taxes; or
-
optional services,
will be communicated before you are bound by the order where applicable.
The total amount payable will be displayed during checkout before you submit your order.
Prices may change from time to time.
A price change does not affect an order for which a binding purchase agreement has already been concluded.
10. PRICING ERRORS
We make reasonable efforts to ensure that prices displayed on our website are correct.
If an obvious pricing or technical error occurs, we may contact you before fulfilling the order.
We will not rely on a pricing error to cancel a binding consumer agreement where doing so would be contrary to applicable law.
Where the price was clearly incorrect and you knew or reasonably should have understood that the displayed price was an obvious error, applicable law will determine whether a binding agreement was formed.
If necessary, we will give you the option to purchase the product at the correct price or receive a refund.

12. ORDER CONFIRMATION AND FORMATION OF THE AGREEMENT
After you place an order, we will normally send an electronic order confirmation.
The confirmation will contain or provide access to relevant information concerning your purchase.
The point at which a binding agreement is concluded will be determined by the ordering process and applicable law.
We reserve the right to decline an order before a binding agreement is formed where there is a legitimate reason to do so, for example:

we cannot deliver to the supplied address;

a personalisation request cannot lawfully or technically be fulfilled; or

13. PRODUCT AVAILABILITY
All orders are subject to product availability.
We aim to maintain accurate inventory information but cannot guarantee that technical inventory discrepancies will never occur.
If a product becomes unavailable after you place an order, we will inform you as soon as reasonably possible.
Where we cannot fulfil the order, you will be entitled to an appropriate refund.
We will not substitute a materially different product without your agreement.
14. PAYMENT
Available payment methods are displayed during checkout.
Depending on availability, these may be provided through Shopify Payments or other third-party payment providers.
Payment must be completed in accordance with the conditions displayed during checkout.
You confirm that you are authorised to use the payment method selected.
We may carry out reasonable fraud-prevention and payment verification checks.
Payment providers may apply their own terms and privacy policies to their services.
15. OWNERSHIP
To the extent permitted by law, ownership of products remains with Pichel Ecom until the full purchase price has been paid.
This does not alter the rules governing when the risk of loss or damage passes to the consumer.
16. DELIVERY
Available delivery destinations, methods, costs and estimated delivery times will be displayed on our website or during checkout.
Delivery estimates are estimates unless a specific binding delivery date has expressly been agreed.
We will make reasonable efforts to deliver within the communicated timeframe.
Where no delivery time has been agreed, the applicable statutory delivery period applies.
17. DELIVERY ADDRESS
You are responsible for providing a complete and accurate delivery address.
Please check your delivery information carefully before placing your order.
If you notice an error after ordering, contact us immediately.
We will attempt to amend the delivery information where reasonably possible, but this may no longer be possible once an order has been processed or transferred to the carrier.
Nothing in this provision limits our obligations where a delivery issue is caused by Key & Hide or a carrier for whom we are legally responsible.
18. DELIVERY AND TRANSFER OF RISK
For consumer purchases, the risk of accidental loss or damage passes in accordance with applicable consumer law.
In general, where we arrange delivery, the consumer bears the risk only after the product has been physically received by the consumer or a third party designated by the consumer, other than the carrier.
Different rules may apply where you independently instruct a carrier that was not offered by us.
19. DELIVERY DELAYS
Occasionally, delivery may be delayed because of circumstances such as:

severe weather;

strikes;

22. RETURNS AND REFUNDS

If there is any conflict between a voluntary return condition and a mandatory statutory withdrawal or warranty right, the mandatory statutory right prevails.
23. STATUTORY WARRANTY AND CONFORMITY
All products sold to consumers are subject to applicable statutory conformity requirements.
A product must possess the characteristics and performance that a consumer may reasonably expect, taking into account circumstances such as:

If Key & Hide offers an additional commercial warranty for a specific product, the conditions and duration of that warranty will be communicated separately.
Any voluntary commercial warranty is in addition to, and does not replace or restrict, your statutory consumer rights.
25. PROMOTIONS AND DISCOUNTS
Promotional offers may be subject to additional conditions communicated at the time of the promotion.
Unless otherwise stated:

discounts cannot be exchanged for cash;

discount codes apply only during the stated validity period;

a discount may apply only to eligible products;

discount codes may be limited to one use per customer or order; and
-
multiple discounts may not be combinable.
Promotional conditions do not affect mandatory consumer rights.
We may cancel or refuse the use of a promotional code where there is clear fraud, abuse or technical misuse.

30. REVIEWS AND USER-SUBMITTED CONTENT
Where our website allows customers to submit reviews, photographs or other content, you remain responsible for the content you submit.

34. INDIRECT BUSINESS LOSSES
If you purchase products as a consumer, we do not seek to exclude liability for losses that are a foreseeable consequence of our breach where such liability cannot legally be excluded.
If you purchase products wholly or predominantly for business or professional purposes, Key & Hide will not be liable for indirect or consequential commercial losses, loss of profit, loss of revenue or loss of business opportunities except where such limitation is prohibited by law or the loss results from intentional misconduct or another form of liability that cannot legally be limited.
35. FORCE MAJEURE
We will not be considered in breach of an obligation to the extent performance is prevented by an event outside our reasonable control, where recognised by applicable law.

Disputes may be submitted to a competent court in accordance with applicable jurisdiction rules.
Nothing in these Terms requires a consumer to bring proceedings exclusively before a Dutch court where mandatory consumer jurisdiction rules give the consumer the right to bring proceedings elsewhere.
39. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.
The remaining provisions will continue to apply to the extent legally possible.
40. NO WAIVER
If we do not immediately enforce a contractual right, this does not automatically mean that we waive that right.
Any exercise of contractual rights remains subject to applicable law.
41. CHANGES TO THESE TERMS
